Terms of Service
Effective 14 September 2026 · Terms of Service version 2026-09-14
These terms form the agreement between you and Margin Analytics Limited for your use of MARGIN. Please read them — they cover your subscription, what MARGIN does and does not do, and how responsibility is shared.
1. Who provides MARGIN
MARGIN is provided by Margin Analytics Limited, a company incorporated in New Zealand (“MARGIN”, “we”, “us”). Contact: support@marginnz.com. “You” means the person who holds the account and the business on whose behalf the account is used.
2. Accepting these terms
By creating an account, or by continuing to use MARGIN, you agree to these terms and acknowledge our Privacy Policy. We record the version you accept and the date and time of acceptance. If you do not agree, do not use MARGIN.
We may update these terms as the service develops. The effective date and version above will change. Where a change is material we will notify account holders and may ask you to accept the updated terms before continuing.
3. Eligibility and your account
You must be at least 18 years old and using MARGIN for business purposes. You agree to provide accurate account details, to keep your login credentials confidential, and to be responsible for everything done under your account. Tell us promptly at support@marginnz.com if you believe your account has been accessed without your authority.
MARGIN is supplied for business use, so the Consumer Guarantees Act 1993 does not apply to your use of it, and you agree that section 43(2) of that Act applies.
4. Authorised use of your business account
Your subscription covers one business and the people you authorise to use that business account. You are responsible for the actions of those people. Do not share access with anyone outside your business, and do not resell, sublicense or provide MARGIN to third parties as a service.
5. What MARGIN is
MARGIN is a business decision-support and pricing intelligence tool. It produces calculations, analysis and indicative guidance based on information you supply, information extracted from business records you upload, and publicly available information.
MARGIN informs your decisions — it does not make them. You remain responsible for reviewing the information MARGIN produces and for your own pricing, quoting and business decisions.
6. What MARGIN is not
MARGIN is not accounting software and does not provide accounting, tax, legal, financial or quantity-surveying advice. It is not a substitute for your accountant, adviser or quantity surveyor.
We do not guarantee any level of profit, margin, revenue, pricing outcome, market accuracy or business performance. Rate guidance, market rate information and benchmark comparisons are indicative only, are drawn from published third-party sources that may be out of date, incomplete or wrong, and are never an instruction on what to charge.
7. Your information, uploads and AI extraction
The figures MARGIN produces depend entirely on the accuracy and completeness of the information you enter or upload. You are responsible for that information, including information about your customers and suppliers, and you confirm you are entitled to upload each document you provide and to have it processed as described in the Privacy Policy.
Uploaded files are read once to extract figures and are not retained by us. Extraction and analysis use artificial intelligence and can contain errors or omissions, so suggested figures are a starting point only. You must review and correct them before saving, and you are responsible for what you accept. Supported files are PDF, XLSX, XLS and CSV, up to 10 MB.
8. Subscription, trial and pricing
MARGIN is a single subscription plan of NZ$30/month including GST. New businesses may start a 7-day free trial. A valid payment card is required to begin the trial, and nothing is charged while the trial runs.
Unless you cancel before the trial ends, the first monthly payment is taken when the trial finishes and the subscription then renews automatically each month until cancelled. Prices are in New Zealand dollars and include GST where GST applies. We may change the subscription price on at least 30 days' notice to you; the new price applies from your next renewal after that notice.
9. Cancellation and refunds
You can cancel at any time from Manage billing inside your account. Cancellation stops future payments. It is not immediate in effect: you keep full access for the remainder of the trial or paid period you have already started, and access ends at the end of that period. We do not provide pro-rata refunds for part-months or for periods already paid, and payments already taken are not refundable, except where a refund is required by law or where we have charged you in error. If you believe you have been charged incorrectly, contact support@marginnz.com and we will investigate and correct genuine billing errors.
When no subscription or other access remains, your stored business data is retained and your account becomes limited to the billing page — your data is not deleted because a subscription ended. Deletion requests are handled as described in the Privacy Policy.
10. Payment failure
Payments are processed by Stripe and card details are handled only by Stripe. If a payment fails, Stripe will retry it in line with its normal process and we will keep your access open during that time so you have a chance to fix the payment method. If payment is not completed, access is restricted to the billing page until the subscription is brought up to date. You remain liable for amounts properly due for periods in which you had access.
11. Acceptable use
Use MARGIN only for your own business and only lawfully. You must not attempt to access another business's data, probe or interfere with the security or operation of the service, use automated means to scrape or overload it, reverse engineer or copy the software, upload malicious code or unlawful content, or use MARGIN to build a competing product.
12. Intellectual property
We own MARGIN — the software, calculation methods, design, content and trade marks. You are granted a non-exclusive, non-transferable right to use MARGIN for your own business while your subscription or access is current. Nothing in these terms transfers ownership of MARGIN to you.
You own the information you enter and upload. You grant us the rights needed to host, process, display and back up that information so we can provide the service to you, and to use aggregated, de-identified information that does not identify you or your customers to operate and improve MARGIN.
Feedback and suggestions you send us may be used to improve MARGIN without obligation to you.
13. Confidentiality and data handling
We treat your business and financial information as confidential. We will not disclose it except: to the service providers listed in the Privacy Policy who process it on our behalf; to authorised MARGIN administration staff where necessary to operate the service, support you, or manage billing; with your consent; or where required by law. We handle personal information as set out in the Privacy Policy, which forms part of these terms.
14. Availability, maintenance and changes
We aim to keep MARGIN available and reliable, but we do not promise uninterrupted or error-free service. Access may be unavailable during maintenance, updates or circumstances outside our control, including failures by hosting, payment or AI providers.
MARGIN is actively developed. Features may be added, changed or removed. Where a change materially reduces core functionality you rely on, we will give reasonable notice, and you may cancel if the change does not suit your business.
15. Suspension and termination
You may stop using MARGIN at any time, and cancel as described above. We may suspend or terminate your access if you breach these terms, if payment remains outstanding, if your use threatens the security, integrity or lawful operation of the service, or if we are required to do so by law. Where practical we will give notice and an opportunity to fix the problem first. On termination your right to use MARGIN ends; retention and deletion of your data follow the Privacy Policy.
16. Limitation of liability
Nothing in these terms limits or excludes any right or remedy you have that cannot lawfully be limited or excluded, including under the Fair Trading Act 1986 and, where it applies, the Consumer Guarantees Act 1993, or liability for fraud, wilful misconduct, or death or personal injury caused by our negligence.
Subject to that paragraph: MARGIN is provided on an “as is” basis and, to the extent permitted by law, we exclude all warranties, representations and guarantees that are not expressly set out in these terms.
To the extent permitted by law, we are not liable for loss of profit, loss of revenue, loss of anticipated savings, loss of business or opportunity, loss of goodwill, loss or corruption of data, or any indirect or consequential loss, however arising. In particular, we are not liable for pricing, quoting or business decisions you make using MARGIN, or for the accuracy of information you supply or of published third-party market information.
To the extent permitted by law, our total aggregate liability to you arising out of or in connection with MARGIN and these terms, whether in contract, tort (including negligence), equity or otherwise, is limited to the greater of the total subscription fees you paid us in the 12 months immediately before the event giving rise to the liability, or NZ$500.
Each party must take reasonable steps to mitigate its loss. You are responsible for keeping your own records of your business information; MARGIN is not a substitute for your accounting system or your own backups.
17. Governing law
These terms are governed by the laws of New Zealand, and you and we submit to the non-exclusive jurisdiction of the New Zealand courts. Before starting proceedings, both parties will attempt in good faith to resolve any dispute by discussion, beginning with an email to support@marginnz.com.
18. General
If any part of these terms is unenforceable, the rest continues to apply. A delay in enforcing a right is not a waiver of it. You may not transfer your account without our written consent; we may transfer these terms as part of a sale or reorganisation of our business. These terms, together with the Privacy Policy, are the whole agreement between us about MARGIN.
